§1. Who sells

The Seller is Hotel Demo — dane przykładowe, ul. Hotelowa 1, 00-001 Warszawa, tax ID (NIP) 1234563218, operating the venue Bistro Nad Rzeka at ul. Hotelowa 1, Warszawa (the “Venue”).

This website runs on software provided to the Seller by a third party, which is not a party to the sales contract.

These terms set out how to order food and drinks from the Venue's menu through this website for collection in person and for delivery to a given address.
To place an order you need a device with internet access and an up-to-date browser. No account is required.
Sending unlawful content through the form is prohibited.

The guest chooses items from the menu, the required options and extras and the fulfilment method, and then gives their name and phone number and, for delivery, the delivery address.
Before sending, the website shows an order summary: the items, the delivery fee and the amount to pay.
The order is placed when the confirmation button is selected. The contract is concluded when the Venue accepts the order; until then the Venue may decline it, in particular because ingredients are unavailable or the kitchen is at capacity.
If the Venue declines an order paid in advance, the Seller refunds the full payment using the same payment method.
After placing the order, the guest receives the address of a page showing the order status.

Prices on the website are gross prices in PLN and include tax.
Available payment methods: electronic payment in advance, handled by the payment operator used by the Seller.
Selecting the “Order and pay” button means placing an order with an obligation to pay.
The sales document (receipt or invoice) is issued by the Seller. To get an invoice, ask the Venue.

Orders for collection are collected by the guest at the Venue.
Delivery is made within the area and for the fee shown before the order is placed. The delivery time shown is an estimate.
Orders are accepted during the hours shown on the website.

An order that has not been paid can be cancelled by the guest on the status page until the Venue hands it over, gives it to the driver or adds it to a bill at the Venue.
An order paid in advance and an order that can no longer be cancelled on the status page can only be cancelled by agreement with the Venue.
If an order paid in advance is cancelled, the Seller refunds the payment using the same payment method.

The food and drinks ordered are goods that spoil quickly or have a short shelf life. Under Article 38(1)(4) of the Polish Consumer Rights Act of 30 May 2014, the right to withdraw from a distance contract does not apply.

The Seller is responsible for the goods conforming to the contract under the Polish Consumer Rights Act.
Complaints can be made at the Venue, by phone at +48 000 000 000 or by email to sprzedawca@example.com, quoting the order number and describing the issue.
The Seller responds to a complaint within 14 days of receiving it.
Consumers may use out-of-court complaint and redress procedures, for example by contacting a municipal or district consumer ombudsman or the regional Trade Inspection inspector. Information: uokik.gov.pl.

The controller of the personal data given in the order is Hotel Demo — dane przykładowe, ul. Hotelowa 1, 00-001 Warszawa.
Data given in the order is processed to accept and fulfil the order and to handle complaints. The Seller provides information on how it is processed on request at sprzedawca@example.com.

Allergen information is shown next to menu items. If you have an allergy or food intolerance, please contact the Venue before ordering.

Matters not covered by these terms are governed by Polish law. These terms do not limit consumer rights under mandatory provisions of law.
Each order is governed by the terms as worded when the order was placed.
